Advertising, Promotion and Compliance Guidelines - Ontario

Who Regulates BVGroup in Ontario?

BV (Canada) Limited (“BVGroup”) holds a remote operating licence from the Alcohol and Gaming Commission of Ontario pursuant to an agreement with iGaming Ontario Advertising and promotional activities undertaken by BVGroup, or you, on behalf of BVGroup, are regulated by:


• The Registrars Standards for Internet Gaming/ Advertising and Marketing (The Standards)
• Marketing and Advertising Conditions (iGO)
• Personal Information Protection and Electronic Documents Act (PIPEDA)
• Canadian Code of Advertising Standards (ASC);
• Competition Bureau Canada;
• Ad Standards Canada (ASC);
• Alcohol and Gaming Commission of Ontario (AGCO); and
• iGaming Ontario (iGO).


To ensure compliance with the above licence and regulatory obligations, all affiliate advertising of the “BVGroup” brand must be as set out in this document.

What is the BVGroup Affiliate Team doing to ensure compliance?

• Communicating relevant changes to affiliates when required;
• Appointed a dedicated Affiliate Security and Compliance Officer;
• Working closely with the BVGroup Legal, Compliance and Risk Team;
• Updated our Affiliate Terms and Conditions;
• Reviewing all affiliate websites/social media pages promoting the “BVGroup” brand on a constant basis;
• Providing compliant creative for the Affiliate to use on its site available within the Affiliate Programme.

Affiliate Content on which mediums are impacted by the AGCO and iGO?

  • Including (but not limited to):

    • websites;
    • social media;
    • banners;
    • in-game ads;
    • hyperlinks;
    • promotional codes;
    • E-promotions;
    • paid ads on Facebook
    • posts on Facebook, X, Instagram etc;
    • websites made to look like editorial content; and
    • blog posts.

What else does the AGCO and iGO require?

Here is the concrete “at a minimum” requirements currently reflected in the AGCO’s Standards:


Advertising, marketing, and communications shall not: 

  • Be based on themes or language that primarily appeals to minors.
  • Appear adjacent to youth-oriented locations (e.g., schools).
  • Use figures likely to appeal to minors (including cartoon characters, celebrities, influencers).
  • Use active/retired athletes except for responsible gambling advocacy.
  • Use individuals who are minors to promote gaming.
  • Appear in media primarily directed at minors.
  • Exploit vulnerabilities of high-risk persons or otherwise glorify gaming.
  • Entice or attract known high-risk players—measures must be taken to avoid this.

In addition to this;

Affiliates must not:

  • Offer, advertise, or promote:
    • Bonuses
    • Free bets
    • Welcome offers
    • Odds boosts
    • “Bet & Get”, “Risk-Free”, etc.
  • Anything else that might be considered an Inducement
  • Use call-to-action language implying an inducement
    (e.g. “Sign up now and get…”, “Claim your bonus”)

 

Further to this iGO require that all affiliates;

  • Display the official iGO logo alongside the operator’s logo on their site.
  • Use only the approved logos from iGO’s logo suite, without modification.
  • Adhere to iGO/AGCO advertising and marketing policies (responsible gambling, age-gating, jurisdiction targeting, etc.)

What are the BVGroup brand requirements?

All BVGroup branding on the affiliate site must include:

  • Correct BVGroup branding (as set out in our brand suite);

  • The logos displayed here are the only logos on-brand and approved by BVGroup.
  • If your BVGroup banners don’t have the font, structure and CTA button colour of the then please update
  • Please ensure all Social Media posts include the terms as laid out

What happens if BVGroup receives a complaint about an affiliate advert?

  • In accordance with Clause 6 of the Affiliate Terms and Conditions, BVGroup will disclose the affiliate’s contact details to the complainant directly.s contact details to the complainant directly.s contact details to the complainant directly.
  • Should BVGroup receive a regulatory fine, the Affiliate will be required to reimburse BVGroup in full for the amount of the fine.
  • We remind you of the obligations relating to promotions set out in Clause 6 and Clause 7 of the Affiliate Terms and Conditions and ask you to contact us where you require any clarity or have a concern.

What happens if the Affiliate Fails to Comply with the Regulations and/or the Affiliate Terms and Conditions?

BVGroup may:

  • Close the Affiliate’s account;
  • Withhold further commission;
  • Require reimbursement of any fine imposed on BVGroup as a result of the Affiliate’s actions.
